2006 Update

THE NEW BOAT PIER IS A HUGE SUCCESS!!! All the boat slips have been rented. If you are interested in renting a boat slip in the future we are keeping a list of all interested members. Contact Kristen Daun to have your name placed on this list.

ATTENTION ALL BOATERS All moored boats need to use round, orange, floating buoys attached to your mooring system. The orange buoy needs to have your boat sticker number clearly visible in black writing. This will help lessen confusion during the season. In addition, once the season begins and moorings are marked, the unused moorings will be removed from the boating area. The orange buoys need to be removed come fall, many members did not remove their buoy last season. Please remember to do so this season!!!

 

 

2005 Boat Slip Voting Update

Dear LVVA Members:

Thank you for attending the spring meeting, (amidst the snowflakes), held in the Daun's garage/driveway. The main focus of the meeting was to vote on whether to have boat slips available, for a yearly fee, or not have them at all. The vote that was taken by ballot during the meeting resulted in 27 “yes” votes and 7 “no” votes. For your information only, many additional members asked to vote by proxy, completing a ballot and handing it in the morning of the meeting. These ballots resulted in 25 “yes” votes and 1 “no” vote. Although the votes of the members, which were not at the meeting, did not count as “official” votes, we wanted everyone to be aware of the results. It’s obvious that the majority of the members feel the addition of boat slips will benefit our association financially and “please” the boaters that want the conveniences a boat slip offers.

I want to address the “concern” of a few members regarding the By-Laws and specifically Article VIII, Section B. The question was raised at the meeting if the board had the right to even have boat slips for rent at the association property in light of this particular Article. The Article reads as follows:

“No building shall be constructed on said property, nor shall any conveyance, mortgage, sale, lease or other encumbrance be made of or upon said property without the prior approval by the affirmative vote of two-thirds (2/3) of the members of the Association upon a petition signed by two-thirds (2/3) of the legal owners of all lots in Lake View Villa Subdivision and presented to the officers and directors of the Association for a vote by the members of the Association.”

The board members did not feel this Article restricted the association from seasonally installing boat slips for our members to use, for a fee. Since there was a “difference of opinion” on this important issue, we wanted to be completely sure we understood the Article before moving ahead with the boat slip order and installation. We decided to consult with a local Attorney, Mr. Richard Nakon located in downtown Wauconda. After reviewing our By-Laws and Trust language, it was the professional opinion of Mr. Nakon that we were not in violation of the Article VIII, Section B. It was his opinion that this refers to a “permanent” type of building or structure built on or attached to the land. Since we will be putting the boat slips in and out every season, we are not encumbering the property in any way.

We respect all opinions from our members. We appreciate the opportunity to address any confusion there might have been regarding this Article and hope this helps everyone to understand it better.

ORIGINAL 2005 MESSAGE:

Over the years, we’ve had many requests to obtain boat slips. Its’ always been a daunting task, one we’ve never come to realize in the past, for many reasons. This year will be the first year we WILL have boat slips. How many slips will depend upon the immediate response we receive. Our boat slip committee has worked long and hard to obtain the best possible, most cost effective, longest lasting system we can for our members.

We’ve decided on a vinyl and aluminum decking system that has a life long guarantee. The system looks great and for all practical purposes, should last forever! The only way we can get the system started is to have a 3-year commitment from each interested member. We need $1500 for each slip sold, to purchase enough pier sections to make this happen. This $1500 investment will “reserve” the member a boat slip through the year 2007. Obviously, each member must still purchase beach tags each year, live within LVVA boundaries, and be in good standing with the association. You will not “own” the boat slip. Each year after 2007, you have the right of first refusal and can keep the slip as long as you pay the yearly rental fee, starting in 2008. (The yearly rental fee will be determined at a later date.) If you move from LVVA sometime before the 3-year period is up, the board will refund the determined “unused” portion to that member. Legally, we can’t have any “transferring” or “selling” the boat slip to new homeowners. It would involve documentation at closing etc and would get into legalities that the association would not want to be involved in. Hopefully, this won’t be a problem for anyone.

If we have enough orders, at least 10, we will obtain boat slips this year. If the response is huge, we will get as many as we can. If an “initial” system is purchased, installed and “envied” by many other members, we could possibly order another system this year. We’ll see as we go. Or, the association secretary will keep a waiting list of interested members and we’ll work that way. At any rate, we hope to have a beautiful pier and boat slip system installed this spring!
